DUIs (also referred to as DWI, OVI, OUI, or OWI in other states) are loosely referred to as an “every person or common person crime.” The reason is it can happen to people who are otherwise “law-abiding.” You’ve probably heard people say, “but for the grace of God, there go I.” All of this may be true, but DUIs are among the most life-affecting and financially significant crimes for most people. The Florida legislature has mandated that a DUI carries a mandatory conviction and directs minimum terms, even for first-time offenders.
Consequences of a DUI conviction can include, but not limited to Probation, driver’s license suspension, vehicle immobilization, ignition interlock (a breathalyzer installed in your vehicle to detect if there is alcohol on your breath), DUI School, drug evaluation and recommended treatment, a victim impact class, random drug testing, fines and costs, and most significantly, jail.

DUI Diversion
A DUI Diversion or “wet reckless” is when your case is reduced to a Reckless Driving charge and you receive a withhold of adjudication (a non-conviction). Having a Reckless Driving instead of a DUI can be hugely beneficial. First off, you don’t have a conviction on your records–and that is a big deal! Second, the diversion doesn’t carry a driving suspension. Third, it may have less of an impact on your car insurance. Fourth, reckless driving just sounds better to an employer versus a DUI.
